HC asks Nurmahal girl to go with her ‘free will’

Justice Naresh Kumar Sanghi pronounced this order on November 14, while disposing of a habeas corpus petition filed by Jyoti Masih, sister of Alisha Masih, who was arrested by the Nurmahal police on rape charge.

The Punjab and Haryana high court has allowed a local girl to go with her “free will wherever she likes”. Justice Naresh Kumar Sanghi pronounced this order on November 14, while disposing of a habeas corpus petition filed by Jyoti Masih, sister of Alisha Masih, who was arrested by the Nurmahal police on rape charge.

The order said the alleged detenue Ankita was present in the court along with her uncle and mother when her statement was recorded separately, She stated that she had solemnised marriage with Alisha Masih with her free will and consent, said the order.

She said she wanted to go with petitioner Jyoti, sister of her husband Alisha, since Alisha and his relatives had been arrested, said the court. The court said Ankita was free to go with her free will wherever she likes.

The Nurmahal police had registered a case under various sections of the Indian Penal Code (IPC) against Alisha Masih, his mother and father, and arrested Alisha and his brother-in-law Vikas Kumar.

Investigating officer Hardevpreet Singh said police would present a challan in the court in this case.
