The court of additional sessions judge Poonam R Joshi sentenced a gangrape accused to 10-year imprisonment on Wednesday. The co accused, his brother, had died a few months ago in the jail while his uncle has been declared a proclaimed offender.
The 30-year-old victim, a resident of Garle Dhaha village of Nawanshahr district, who lived separately from her husband, had alleged that Saila Khurd residents Mandip Singh, his brother Gaurav Kumar and uncle Amrit Lal had waylaid her in May 2012 when she was returning from a gurdwara with his acquaintance Harvinder Singh.
They had assaulted Harvinder and kidnapped her in a Toyota Innova. She alleged that she was later gangraped by the three before abandoning her near Jahan Khelan. The Sadar Police had registered a case and arrested the two brothers.
Mandip was on Wednesday sentenced under Sections 376 (2) (G), 326 (grievous hurt), 324 (voluntarily causing hurt) 341 (wrongful confinement) and 34 (criminal act by many with common intention) of the Indian Penal Code. He was also fined Rs 1.05 lakh under Section 376 (rape) of which Rs 1 lakh would go to the victim.
Defense lawyer BS Riar tried to prove in the court that the case was registered by the complainant out of vendetta as her acquaintance, his brother and mother were convicted in a rape case filed by Mandip's sister in 2013. He put on record several pending litigation between the two parties, but the court overruled his claim.
