In a swift action, the Jalandhar rural police on Saturday arrested constable Sanjeev Kumar, posted at city's police station division no 4, on the charges of sodomising an eight-years-old boy while the city police "summarily" dismissed him from the government service for indulging in the crime.
Police commissioner Gaurav Yadav said that Sanjeev Kumar has been dismissed from government service after he was arrested by the rural police on the charges of sodomising a minor boy.
"His involvement in such a heinous crime against an innocent child deserved to be given strictest of strict punishment. It is gross misconduct on his part despite being a member of a disciplined police force. His dismissal from service will give clear signal to all stakeholders that we are not going to tolerate such illegal and inhuman acts," Yadav said.
Sanjeev, who was absconding since last night, was "summarily" dismissed from the service under article 311 (2) b of the constitution of India and relevant provisions of the Police act without putting him to face any departmental inquiry. The legal provisions allow such dismissal provided that the authority empowered to dismiss a person or to reduce him in rank is satisfied that for some reason, to be recorded by that authority in writing, it is not reasonably practicable to hold such inquiry.
Meanwhile, superintendent of police (SP) Rajinder Singh said that a police party arrested Sanjeev from Gaddaipur area on Saturday. During preliminary interrogation, the arrested cop revealed that the victim and his 11-years-old sister came to his room to watch television. He offered them biscuits. "While the girl went back to her room after watching television programme for some time, the boy stayed back little knowing the evil designs of Sanjeev.
Taking advantage of the situation, drunken Sanjeev overpowered the victim and forced him into anal course. The boy screamed for help, but to no avail. It was after some time that Sanjeev realised that the boy was bleeding profusely. He got scared and released the boy, who somehow managed to reach his room," Rajinder Singh revealed. The accused was being produced in the court.
The accused originally belong to Sheikhupura village in Kapurthala district. He had developed strained relationship with his wife nearly 12 years back and the couple was living separately since then. Sanjeev was living in his sister's property at Gaddaipur area while she was settled abroad. Sanjeev's mother was living with him till recently, when she decided to shift her base to her daughter's place two months back, the police said.
"He is ashamed of himself," SP Rajinder Singh said.
Section 377 of the Indian Penal Code
Unnatural offences-- Whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment for life or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine. Penetration is sufficient to constitute the carnal intercourse necessary to the offence described in this section.
