HC quashes FIR against union leader

Punjab and Haryana high court has quashed First Information Report (FIR), challan and court proceedings against numbardar union leader Ashok Sandhu.


In her order, justice Sabina said that from a perusal of the FIR it appeared possible that the FIR in question might have been lodged due to strained relations between the petitioner and his brother Tirath Ram Sandhu. Hence, it would be just and expedient to quashcriminal proceedings as in the case, the said proceedings are allowed to continue the same would be misuse of process of law.

The court said that FIR no. 55 dated August 15, 2011, under Section 2 of Prevention of Insult to National Honour Act, 1971, and Section 186 of the IPC had been registered at the Nurmahal police station and all consequential proceedings arising there from are quashed.

The FIR stated that when nagar council president Tirath Ram Sandhu was about to unfurl the flag, the accused Ashok Sandhu pulled its strings with an intention to insult the national flag.
