Man convicted of raping daughter

The court of additional sessions judge Poonam R Joshi has convicted a 50-year-old man for his minor daughter's rape and sentenced him to 12 years of imprisonment. He was also awarded one year sentence under Section 506 (criminal intimidation) of the Indian Penal Code and seven years under the Protection of Children from Sexual Offenses Act (POCSCO). All the sentences will run concurrently.

The case
In August 2013, the 14-year-old victim confided in her maternal grandmother that she was being raped by her father, who had remarried after the death of her mother, for the last several months. She had also alleged that she had been threatened to not disclose the matter to anyone.
A complaint was then lodged with the Sadar police, and a case was registered against the girl's father Kamaljit Singh, a resident of Bains Colony, Una Road. He was later arrested after the medical examination of the victim showed that she had indeed been sexually abused.

Defence counsel's argument
The defense counsel tried to argue before the court that the allegations had been made out of personal vendetta against the accused as he had remarried.
However, the judge said that no girl would put her honour at stake by making false accusations of such a grave nature. She also imposed a fine of Rs 5 lakh on the convict and ordered that of the amount, `4.90 lakh be awarded as compensation to the victim.
