PSPCL barred from charging commercial tariff form lawyer

The district consumer disputes redressal forum has issued an interim order restraining the Punjab State Power Corporation Limited (PSPCL) from recovering impugned bill and disconnecting the electricity connection of a consumer till further order.

The consumer, Baltej Singh, a lawyer, has filed a complaint with the consumer forum that he had received the electricity bill of his chamber at the district courts complex under the commercial tariff.

The complainant cited a judgment of the Rajasthan high court in a case titled as Sajjan Raj Surana Vs Jaipur Vidyut Nigam Ltd reported in 2002 (3) RCR (Civil) 771, wherein the court had held: the practicing advocate or lawyer by his legal profession cannot be treated as carrying on commercial activity and his office cannot be termed as a commercial establishment and for that reason an advocate or lawyer’s office cannot be charged under the commercial tariff.

The orders issued unanimously by a full three-member bench, including forum president Naveen Puri and members GBS Bhullar and Jagdeep Kaur. However, they stated that the complainant would be bound to pay the subsequent bills regularly without any default.

The forum has fixed January 12 for the next hearing in the case.
