The high court has asked the Punjab government to revise the pension of pre-2011 retirees. The court was hearing a bunch of petitions of education department employees, who retired before 2006 and between 2006 and 2011.
The bench of justice Kuldip Singh held that pre- January 2006 retirees are entitled to re-fixation of their pension as per December 2011 notification of the government but without any retrospective effect.
Those who retired between January 2006 and December 2011 have also been held entitled to re-fixation of the pension from December 2011 but without any retrospective effect. The government has been asked to carry out necessary follow up within three months.
The HC rejected the circular of June 2012 whereby the government had argued that the pension was to be revised only once with reference to the initial pay of revised scale of 5th pay commission with effect from January 2006 and subsequent revision of pay scales of December 2011 had no correlation with the pension of the pensioners. CM Chopra, the counsel associated with the case, said the judgment affects a large number of employees who retired before 2011.
