The Punjab and Haryana high court on Friday stayed the operation of recovery certificate notification of Rs 9.5 crore by special secretary, department of new and renewable energy, against Kapurthala’s Congress legislator Rana Gurjit Singh.
The order from single-judge bench of justice RN Raina is based on three petitions by the MLA, Rana Ranjit Singh, and Rajbans Kaur, whereby the recovery certificate of was challenged. The high court has also issued notices for February 4 to the Amritsar deputy commissioner, Punjab Energy Development Agency (PEDA), special secretary, department of new and renewable energy, and a government-authorised officer. The petitioners had argued that the recovery certificate — notifying special secretary as authorised officer for the purpose — had been issued without hearing them out and so was illegal.
The recovery of Rs 9.5 crore has been sought under the Punjab Public Moneys (Recovery of Dues) Act, 1983. The three petitioners are promoters of Rana Sugars, for which they had entered a tripartite agreement with PEDA.
