The petitioners challenging the Punjab government's July 26, 2011 notification declaring municipal council of Moga to be a larger urban area and constituting it municipal corporation, have withdrawn the petition resulting in vacation of high court's stay.
Three petitioners from Moga, including the sitting councilor from ward no 4 Surender Singh, filed an application in the court of justice Ajay Tewari of the Punjab and Haryana high court on Wednesday that they did not want to pursue the case further.
The petitioners had challenged the notification submitting that it did not even fulfil the criteria set by the government itself in 1999 with regard to population and income etc. for constitution of the corporation.
The high court had stayed the government's notification on October 17 last year in case of Moga. However, later on January 17 the high court had reserved its decision on the conversion of municipal councils of Moga, Pathankot, Phagwara and Mohali into corporations.
