The Delhi HC on Friday quashed the criminal proceedings against Yahoo India initiated by a lower court for hosting objectionable content and held that there was no evidence against it.
The order comes a day after a lower court dropped the proceedings software giant Microsoft finding that it was only a company engaged in development and sale of software and could in no way be clubbed with sites hosting offensive material.
Officials of Yahoo along with other 20 sites were summoned by a lower court on March 13.
HC upheld the contention of senior advocate Arvind Nigam, appearing for Yahoo India that there were no documents to prove that the site hosted objectionable content and that it was merely a social networking site, which provided email and other services.
Nigam said the lower court should not have been casual in issuing the summons and should have considered "the material on record".
