The Allahabad High Court on Wednesday dismissed as withdrawn a petition by jailed BSP candidate from Varanasi, Mukhtar Ansari for a direction that he should be produced before the returning officer for filing his nomination for the Lok Sabha polls. A division bench comprising justices
Ashok Bhusan and Arun Tandon said the petition "stands dismissed as withdrawn" following a request to this effect made by Ansari's counsel Gopal Chaturvedi.

The counsel's plea came after the Bench appeared dissatisfied with the arguments put forward with regard to the court's query as to why the petitioner did not apply for a "short-term bail" before the sessions court and instead moved the High Court straight away invoking invoking the provisions of Article 226 of the Constitution.

The court was of the view that even if an application for "short-term bail" got rejected by the lower court, the petitioner could have moved he High Court.
