The Central Bureau of Investigation (CBI) on Thursday told the Ghaziabad court hearing the Aarushi-Hemraj murder trial that prosecution witness Kalpana Mandal, a former maid at the Talwars' residence, was "won over by the accused" and "not going to support the prosecution case".
The prosecution witness had worked at the Talwars' Noida residence. She had gone to her hometown a week before the murders and never returned.
Mandal was supposed to be examined on Thursday.
CBI special public prosecutor RK Saini, however, told the court that she was "not to be examined" anymore.
Saini said Mandal was currently working at the residence of Nupur Talwar's parents.
"There is a Supreme Court ruling of 2001 in the Hukum Singh v/s State of Rajasthan that if the prosecutor has reliable information that witness has been won over by the accused, he can skip examining the witness," Saini said.
Defence lawyers termed the allegations as false and Thursday's move as "drama" on part of the CBI to block Nupur Talwar's bail.
The defence counsels requested the Ghaziabad court to direct the CBI to produce the remaining witnesses to comply with the Supreme Court's orders.
Their lawyer Satyaketu Singh termed the move as "mala fide intention" to defer hearing on Nupur's bail plea before the Supreme Court. Her plea will come up for hearing on September 17.
While hearing Nupur's bail application, the SC had on August 13 directed the CBI to produce its 13 witnesses before September 17. It had also directed the petitioner to cooperate during the cross-examination.
The CBI had challenged Nupur's bail on the grounds that witnesses might be influenced if she got bail. Nupur is presently lodged at Dasna jail.
