CBI gets chief justice nod to probe Nirmal Yadav case

The CBI had approached the CJI after a Chandigarh court refused to accept its report asking to close the case against the judge allegedly linked to the cash at door scandal of Punjab & Haryana HC in 2008.
The CJI's decision would allow the CBI to investigate the alleged role of the judge in a land deal in Solan (Himachal Pradesh) and her links with four other accused in the case.
The CBI had informed a special court at Chandigarh on July 16, that it has for the third time sought permission from the government to prosecute the judge. The next scheduled date of hearing in the case is on Saturday (September 4).
The CBI had been pressing to proceed in the case against Justice Yadav, but on two previous occasions it had been denied permission by the Law Ministry to proceed in the case, reported first by HT.
The decision by the CJI, virtually overturns what his predecessor, Justice K.G. Balakrishnan had done, who had agreed with the government that no case was made out against Justice Yadav.
Contacted for her response, Justice Yadav declined to comment, saying she had not been "communicated anything by any authority."
