To curb unauthorised construction in regularised colonies in the Capital, the central government on Tuesday gave a green signal to legalise subdivision of plots and notify changes in the building bylaws.
This means in the 567 regularised colonies, some of the special areas and urban villages, people can build houses with layouts sanctioned by the Municipal Corporation of Delhi (MCD) after due checks on regarding structural safety and illegal construction.
"We received the confirmation on Tuesday. Accordingly the Master Plan of 2021 will also be changed," said AK Walia, Delhi Finance Minister.
"This will benefit lakhs of families."
All subdivisions of plots carried out since February 8, 2007 will be eligible for approval.
Once legalised, the plans and designs for subdivided plots will have to be sent for approval and vetted by the civic body, which will be able to enforce the various structural safety riders.
Recently a building collapse that killed 70 people at East Delhi's Lalita Park was an illegal structure built on a subdivided plot.
"This will also help prevent mishaps that may take place in illegally constructed structures," he said.
According to the Municipal Corporation of Delhi (MCD), there has been a sharp decline in the number of joint families with most residents wishing to divide their properties and carry out different construction activities.
The same, however, was not allowed as per the existing building by-laws.
Apart from not being able to get building plans passed for smaller plots, property owners in the Capital were also not able to get plans passed for individual floors.
"Though the court has permitted the MCD to sanction floor-wise building plans, there are a lot of practical problems in implementing it. One has to get a No Objection Certificate (NOC) from all the floor owners which is a tedious task," said a senior MCD official.
The civic agency admitted that, as it is not allowed to process building plans for sub-divided plots, it leads to rampant illegal constructions in the city.
