A Delhi court has framed charges against five persons who allegedly abducted their friend in a bid to extract Rs 20 lakh in ransom from his trader father and later killed him after knowing that police have been informed.
"I am of the view that there is prima facie sufficient material on record to charge all the five accused for offences of murder, abducting for ransom, destruction of evidence and criminal conspiracy under the IPC," Additional Sessions Judge Manoj Jain said.
Victim Raju Roy, who had left his house at Rohini in Outer Delhi on January 4 this year along with his friend and key accused Biplav, was found dead three days later in his Santro car at Karnal in Haryana.
It was claimed in the chargesheet that the victim was killed by the accused, who had demanded Rs 20 lakh from his father for his safe release, but panicked after knowing that a report had already been lodged with the police in this regard.
The court, while framing charges against accused Biplav, Manish, Hardeep Singh and two others, said though there was no eyewitness to the incident, the circumstances indicated that he was killed by the accused.
"The case is based on circumstantial evidence and keeping in mind the statements of material public witnesses, fact of last scene, recovery effected at the instance of accused and the memos prepared at the instance of accused as well as extra-judicial confession made by one of them indicate that there was prima facie evidence against them," it said.
During the probe, it came to light that accused Biplav was a close family friend of Raju and was last seen in the company of the victim, the chargesheet said.
The court also considered the fact that at the instance of the accused, police had recovered the robbed stereo of the victim's car.
