A woman, sentenced to 15 months’ imprisonment in a theft case, has been ordered to be freed by a Delhi court after completion of 12 months of jail term later this month.
Additional Sessions Judge Rajneesh Kumar Gupta showed leniency to the 30-year-old woman and reduced her sentence from 15 to 12 months on the ground that she has four minor children to look after.
"...keeping in view the submissions of the appellant and the nature of the offence and the fact that the appellant is a lady, the appellant is sentenced to simple imprisonment for 12 months and fine of Rs 1,500 in default simple imprisonment for 15 days. ...the impugned order on sentence is modified," said the court.
The court's order came on an appeal by convict Firoza alias Nazma, lodged in Tihar Jail, against the order of a magisterial court, sentencing her to 15 months in jail for stealing Rs 1 lakh from a house in west Delhi on July 2009 and a fine of Rs 2,000.
Nazma had urged the court to reduce her sentence as she has four minor children and since her husband is also in jail in connection with some other criminal case, there is nobody to look after them.
