A Delhi court has restrained an alleged adulterous man from throwing out his wife and son from his house after 14 years of marriage.
One Laviral (name changed) and Sheila (name changed) got married in 1997. The couple has a four-year-old boy. Sheila through her counsel Prabhjit Jauhar filed a petition in court seeking to restrain her husband from dispossessing mother-son duo from the house. The petition was filed before metropolitan magistrate Shivali Sharma.
Jauhar told the court, "The man is in extra marital relationship. He is trying to bring the other woman inside the house by chucking out the mother and son. With his adulterous nature, he has ruined his wife and son's life."
The court noted that Sheila has placed on record, documents to show that she is in possession of her shared household along with her minor child, and her husband is trying to dispossess her without due course of law.
The judge said, "Considering the submissions made and documents placed on record prima facie petitioner (Sheila) appears to be in possession of matrimonial home. The respondents (Laviral and his family members) are restrained from dispossessing the petitioner out of her matrimonial house."
