The Delhi High Court on Friday issued a notice to Delhi Police seeking a reply to the CBI's closure report seeking discharge of two alleged Al-Badr terrorists.
The Delhi Police Special Cell arrested alleged terrorists Mohammed Moarif Qamar and Irshad Ali with the help of an Intelligence Bureau official in February 2006.
The CBI filed its report on November 11 following an inquiry on the order of the Delhi High Court. In its closure report, the CBI discharged the alleged accused, saying they were just police informers.
“The police have no locus standi in the case. The investigations were handed over to the CBI which has given a clean chit to the accused. The police framed them as they refused to go to J&K to operate as police informers,” said Irshad Ali’s counsel.
The CBI alleged that the Special Cell officials, who were desperate to show results after the Sarojini Nagar blasts in October 2005, fabricated evidence against the two.
The Delhi Police had contended that the agency had failed to collect call details of different mobile phones involved in the case.
