The Delhi High Court has sought an explanation from the Delhi government, DDA and MCD as to why contempt of court proceedings shall not be initiated against them for not complying with its orders to stop pollution of the Yamuna.
The court was acting on a petition filed by environmentalist Vinod Kumar Jain of NGO ‘Tapas’.
He alleged that nothing was being done despite an order, given five years ago, to take all steps to ensure that garbage did not choke Yamuna and turn it into a drain, especially during festivals when idols were immersed and huge quantities of flowers and other items of puja were thrown into the river.
Delhi government, DDA and MCD are to file their replies by February 23.
Jain said people continued to throw waste through the gaps in the iron grill erected on both sides of Nizamuddin and ITO bridges and no action was being taken to prevent it.
Jain pointed out to the court that it had directed the government in 2006 to effectively enforce the Delhi Degradable Plastic Bag and Garbage (Control) Amendment Act to ensure Yamuna’s cleanliness during festivals.
He said in April 2006, the court had asked the government and its various civic agencies to implement all the provisions of the act and make some enclosures on the river bank for immersion of idols during the festival seasons, but no work had been done so far.
“In September 2006, the court had directed the government to take adequate steps to prohibit throwing of garbage and ‘samagri’ (worship materials) in the river bed, drains and sewers, as per the act,” Jain said.
“Except identifying 13 sites, the project has not progressed so far despite the fact that the DDA has released the finances for the enclosure,” he added.
