Giving a new spin to the 2G scam, corporate honcho Sanjay Chandra on Thursday told the Delhi High Court he was neither the Managing Director nor the Director of the Unitech Wireless which had applied for telecom licences in 2007.
This was his main line of defence before the Delhi HC, hearing the bail plea. As per CBI chargesheet, Chandra is the MD of the Unitech Wireless.
Chandra, DB Realty MD Vinod Goenka and three top ADAG executives ADAG group — Gautam Doshi, S Pipara and Hari Nair were arrested and sent to judicial custody after the CBI special court rejected their bail plea on Wednesday. But the five accused failed to get any relief as the hearing on their bail plea was adjourned till Tuesday which meant that they will have to spent at least four more days in jail.
“He was neither a MD nor a Director nor a shareholder in the Unitech Wireless, a company which is an accused in the chargesheet..in fact, he was the MD of the Unitech Ltd which was not even named as accused”, senior lawyer KTS Tulsi representing Chandra submitted before Justice Ajit Bharihoke.
“Special Judge had tarred everybody with same brush. There are specific allegations against Swan Telecom like the money trail of around Rs215 crore. So far as I am concerned, there is no specific allegation against me and the Unitech,” Tulsi said during the five-hour long marathon arguments.
A battery of senior lawyers including former attorney general Soli Sorabjee, Rajeev Nayar and N K Kaul were representing the five accused. They charged the CBI court with violating a 2006 Delhi High Court direction which had said, “bail was a matter of right to an accused who has never been arrested during investigation”.
