A court in New Delhi on Monday sentenced a man to eight-and-half-years' rigorous imprisonment (RI) for kidnapping and raping a minor girl, noting that the act has devastated the life of a girl at a very tender age.
Additional Sessions Judge (ASJ) H S Sharma held Ashok Kumar (30) guilty of kidnapping and raping the four-year-old after finding her alone in her Kirti Nagar residence in North West Delhi, eight years ago.
The court also slapped a fine of Rs 2,000 on the convict, Ashok, a resident of Naraina Village, apart from imprisonment.
According to the prosecution, Ashok had kidnapped the girl on January 24, 1999, from her residence from the lawful custody of her father, Surinder Singh. He took her to a nearby jungle and raped her.
Additional Public Prosecutor (APP) M Singh argued that the convict should be given maximum punishment for his devilish act, which would also act as a deterrent.
"I am of the view that end of justice shall suffice if the convict, Kumar, is sentenced to eight-and-half-years RI for his act, seeing the fact in mind that Kumar is a tuberculosis (TB) patient," the ASJ said.
The prosecution produced eighteen witnesses, including the girl and her parents to prove its case against Kumar. The court had on September 29, 2004, framed charges against him.
"The offence committed by the convict was of such a heinous nature that it has devastated the life of a girl at a very tender age. The lust made him a beast and he made a hapless girl of four years his prey," the ASJ said in his order.
