Former telecom minister A Raja, at present in judicial custody, made a strong plea before the Supreme Court to recall its order that embargoed granting of bail to him until the trial court delivered its verdict on framing of charges in the 2G case.
Senior counsel Sushil Jain told the bench of justice GS Singhvi and justice AK Ganguly that the probe's monitoring by the apex court hampered the trial's progress. He also wanted to know from the CBI whether its probe was complete in the case or not.
“For how long will I have to remain in jail? In the trial court CBI says the investigation is complete but in the Supreme Court it says probe is still on. In the meantime I am suffering and I want to know the status of the probe, whether it is on or has been completed,” Jain asked the bench.
Jain said the trial court had on September 15 reserved its verdict on framing of charges. But, due to new emerging facts placed before it, it had been adjourned.
“An accused must know whether the investigation is on or has been completed. If the probe is complete then the trial must begin ... Look at our plight also. Find out a way for us,” he said, adding that the CBI had slapped additional charges against the accused.
The bench declined to entertain the plea and told Kumar he should avail the remedy before the right forum. When the counsel asked whether the SC or trial court was an appropriate forum, the bench said: “We would not make any comments on this.”
