The Supreme Court on Wednesday gave protection from sealing to The Ambasador Hotel’s property — Vivanta — situated in Sujan Singh Park area of Lutyens Delhi.
Acting on a petition filed by the hotel, a bench, headed by justice VS Sirpurkar, ordered it protection from sealing and posted the matter for hearing on July 14.
Faced with the possibility of being sealed, the Ambassador Hotel had, on Monday, moved the Supreme Court against a SC-appointed panel’s recommendation to seal Vivanta, a heritage structure built by architect Walter George in 1945.
Stating that it was operating at high occupancy, the hotel, in its petition, said the proposed action against it was in violation of law, as it had all valid licences.
Its counsel had contended that the hotel started in 1951 and was also recognised under the Delhi Hotels Act, which mentioned Ambassador Hotel in its schedule.
The first Master Plan of Delhi came into effect in 1962 and all commercial premises existing prior to that are protected under Section 14 of Delhi Development Authority Act.
As the hotel’s counsel asked the court to protect his client against sealing, the court was told that there would be no sealing till Tuesday. The court said it would take up the matter at an appropriate time.
New Delhi Municipal Council (NDMC) advocate Sanjiv Sen maintained that the property in question belonged to the Land and Development Office (L&DO) of the government of India and the NDMC would only act upon the request and direction of the L&DO.
He said as per instructions, the hotel had all the necessary permissions from the civic body.
The SC-appointed monitoring committee recommended sealing of Vivanta on the ground that no building sanction plan for the hotel has been approved by NDMC and no completion certificate issued to them.
