SC slams DDA, LG for permitting unauthorised constructions

Castigating DDA for allowing several unauthorised constructions in the national capital, the Supreme Court today directed the authorities to seal 52 shops in Rajapura Market area of Rohini, which had been de-sealed on the reported orders of the Lt Governor of Delhi.

Castigating DDA for allowing several unauthorised constructions in the national capital, the Supreme Court on Wednesday directed the authorities to seal 52 shops in Rajapura Market area of Rohini, which had been de-sealed on the reported orders of the Lt Governor of Delhi.

A bench of justices G S Sirpurkar and G S Singhvi said DDA failed to produce any material to show that any written order for de-sealing was passed by the Lt Governor and said even if any such an order was passed it amounted to "overreach of the judicial order."

"How can the LG pass such an order. How can you allow the unauthorised constructions despite our orders for sealing all unauthorised constructions in Delhi?" the apex court told senior counsel and former additonal solicitor general Amarender Sharan appearing for DDA and the Lt.Governor.

"Any such order amounts to overreach the judicial order," the bench said.

The apex court brushed aside the counsel's claim that DDA was empowered to pass orders for de-sealing as the government had passed an Ordinance in 2007 for regularising all unauthorised constructions.
