A Delhi court on Thursday convicted a man of cruelty to his wife who committed suicide two weeks into the marriage. The court however, acquitted him of homicide charges, saying there was no “proper and reliable evidence to justify the conclusion of murder”.
While convicting Delhi resident Rakesh Sharma, additional sessions judge Ravinder Dudeja said he was convinced by the appearance of “bruises and lacerations on the victim’s body,” which the accused could not “explain.”
“Undoubtedly, it is a social and heinous crime to have the wife hanged to death,” said the court, while adding, “the husband being the companion in the house ought to be able to explain as to the circumstances under which his wife was found lying hanged in the bedroom, there also exists an obligation on the part of the prosecution to prove the guilt of accused beyond all reasonable doubt.”
It also relied on the testimony of the victim’s brother, which was corroborated by the injuries found on the woman’s body after post mortem.
Sharma was acquitted of the murder charges leveled against him because “no case of murder had been made out against the man and has failed to substantiate the charges.”
According to the prosecution, Sharma had married the woman on March 13, 2012 in Himachal Pradesh.
On March 25, 2012, the woman committed suicide by hanging herself from a ceiling fan at her matrimonial house after being subjected to cruelty and harrassment for dowry. Police alleged that a day before the incident, Rakesh was paid Rs 1.5 lakh as dowry by the victim’s father.
During the trial, Rakesh refuted the allegations leveled against him and claimed that his wife was short-tempered.
