No FIR can be ordered on a complaint against the Delhi transport minister, transport commissioner and others for allegedly allowing the bus in which the December 16 gang rape took place to ply, a court has ruled.

Special Judge Narottam Kaushal disposed of the complaint seeking a direction to the Delhi Police for registration of a case against them, holding that the issues raised are similar to those in the FIR registered against bus owner Dinesh Yadav early this year.

The court passed the order on the complaint filed by RTI activist Vivek Garg against city transport minister and others alleging that the December 16 gangrape incident occurred due to their “corrupt” activities and glaring irregularities in the transport department.

“No fresh FIR can be ordered to be registered on the same facts and circumstances. The present complaint is, therefore, disposed of with no directions,” the court said.

The court, however, said, “Complainant will be within his right to join investigation and make available to the IO (investigating official) any information which may be in his possession/knowledge.”
