Comply with norms or face action: DTP enforcement to Gurgaon mall owners

The enforcement team of the DTP sent fresh reminders last week restoring the utility spaces at malls

The enforcement wing of the department of town and country planning (DTP), Gurgaon, has sent fresh reminders to all malls located in the city to fall in line and leave every inch of utility space free of encroachments.

The officials said that all 24 malls of the city are least sensitive to public utility spaces by occupying every inch for commercial gains inside and outside the mall premises.

The enforcement team sent fresh reminders last week for restoration of utility space and a team of officials is to make a random inspection soon.

Prominent developers of the city such as DLF, Raheja, JMD, MGF, Bestech and others built these malls as per norms of the DTP, leaving adequate space for basement parking, refuge area (for emergency assembly), walkways, corridors, balcony, terrace, public toilets, lift, lobbies among other utilities.

“We inspected every mall of the city located along Sohna Road, MG Road, Delhi-Gurgaon Expressway and at other places and found gross violation of norms. These malls have occupied basements and even public utility spaces outside by allowing vendors to set up food stalls. It marks a clear violation of rules and we are going to take strict action in this regard,” Rajinder Sharma, district town planner, enforcement, said.

Sharma said the use of basement for commercial purpose is in violation of norms. “We sent the first notice in this regard about a fortnight ago and later sent a reminder. While we have received compliance reports from a couple of malls so far, the majority of them are yet to respond to our notice.”

According to an enforcement official, the basement could only be used for parking or a store room or small office for management in exceptional cases. The DTP can seal malls that violate norms.

The official said most of the utility spaces in malls are under unauthorised occupation of food vendors and such violations usually takes place in the evening.

“In many malls, there are retail shops in basements, which is against the rules. The department can initiate legal action such as cancellation of licence and the sealing of premises among others. We wish the mall managements will respond to our reminders and comply,” an official said.

An official of DLF, which runs a few malls in Gurgaon, said, “DLF has complied with the notice issued by the DTP.”

Hindustan Times called up several mall managements, but they refused comments.
