Court directs cops to act against NHAI contractor

The complainant, Ramesh Yadav, a city-based RTI activist, had demanded that action should be taken against the National Highways Authority of India (NHAI) contractor and officials involved in construction of the “faulty” flyover, which has suffered damages twice within a span of one year.

A Gurugram court on Friday directed the city police to submit an action-taken report on complaints related to damages to Hero Honda Chowk flyover within a week.

The complaints were lodged at Sector 37 police station, and also submitted to Gurugram commissioner of police (CP).

The complainant, Ramesh Yadav, a city-based RTI activist, had demanded that action should be taken against the National Highways Authority of India (NHAI) contractor and officials involved in construction of the “faulty” flyover, which has suffered damages twice within a span of one year.

Naveen Kumar, civil judge cum judicial magistrate, observed, “A perusal of complaint prima facie shows that the complainant before filing instant complaint has moved two applications before police station, Sector 37 and commissioner of police, Gurugram. However, the action taken by said police station and concerned CP, Gurugram has not come on record. Therefore, in these circumstances this court is of the considered view that status/action taken report is required to be called from SHO, PS, Sector 37, and CP, Gurugram for May 21.”

On May 8, the flyover had suffered damages after chunks of concrete fell off the carriageway (Jaipur to Delhi side), leaving a large hole in the middle of the surface. This is the second time that the flyover had suffered damage on the same stretch within one year, forcing the NHAI to constitute a three-member technical committee of experts to probe this matter.

Yadav said that this damage clearly pointed to the use of poor quality material in the construction of the flyover and poor workmanship.

“This matter needs to be investigated and criminal liability fixed on those involved in building this flyover as it could endanger the life of the public. A case should be registered by the police and strong action should be taken,” the RTI activist had said, who went to police twice for filing a case, but had to knock the door of the court to get a case
registered.
