Gurgaon will have its own RERA authority

The separate RERA authority will consist of one chairperson and two members

City homebuyers, who had been striving for strong regulations for the real estate industry, may soon have a reason to smile. Gurgaon will soon have its own authority under the Real Estate (Regulations and Development) Act, 2016. The Haryana government said on Thursday that under the Act, two authorities will be set up in the state — at Panchkula or Chandigarh and Gurgaon.

The authority will comprise three persons — one chairperson each and two members.

“We are delighted that government has decided to set up a separate RERA authority for Gurgaon, as this city is home to plenty of real estate projects and many aspire to find their dream homes here. However, the regulations as notified under state RERA represent a clear dilution from the ones that are provided under the Act drafted by the Union government. This has come as a big letdown for us at a time we have been trying to highlight issues related to inordinate delays in possession of flats,” Pradeep Mishra, a homebuyer at Sector 110, said.

On Thursday, a selection committee was constituted in Chandigarh as per provisions laid down under Section 22 of the Real Estate (Regulation and Development) Act, 2016 to invite applications from the eligible candidates for appointment of a chairperson and two whole time members for the regulatory authority.

“While a person bidding to be chairperson should have a professional experience of at least 20 years, those aspiring to be members should have at least 15 years of experience in urban development, housing, real estate development, infrastructure, economics, planning, law, commerce, accountancy, industry, management, social service, public affairs or administration. They should have technical expertise in their relevant fields,” a spokesperson of Haryana government.

“Any person, who is or has been in the service of state government, will not be appointed chairperson unless such person has held the post of additional secretary to the central government or any equivalent post in the central or state government.”

He said, “A person who is or has been in the service of state government, would not be appointed as a member unless such person has held the post of secretary to the state government or any equivalent post in the central government or state government.”

Chairperson and members would hold office for a term not exceeding five years from the date on which they assume office, or until they attain the age of 65 years, whichever is earlier and would not be eligible for re-appointment.

The eligible candidates can submit their applications by September 4, upto 5 pm.

Dilbag Singh Suhag, executive director, RERA, said, “It is good for buyers in Gurgaon that they will have redressal authority at their doorstep.”

Gaurav Prakash, a homebuyer, said, “We have refused to accept the Rera in its present diluted form as it is not going to bring us relief at all. We have decided to move court seeking intervention of the judiciary in implementing the central RERA in the state. A separate RERA authority in Gurgaon will help us in this cause.”
