Residents of the upscale World Spa condominium have sued the developer Unitech and claimed Rs210 crore as damages for not providing them facilities as promised when the flats were sold.
The resident welfare body of the condominium, home to several corporate honchos and senior government officials, filed a case in the consumer forum on Monday, a day after it expelled nearly 140 maintenance staff provided by the developer for “shoddy” operations and hired a new agency.
“A number of facilities that were promised to us have not been delivered. The complex does not fit within the definition of a luxury apartment as promised,” The World Spa Apartment Owners’ Association (TWSAOA) has alleged in its complaint with the National Consumer Disputes Redressal Commission.
The association has asked for “immediate refund of their maintenance security deposits, completion of the 37 apartments which are yet to be handed over, compensation for sub-standard construction and other damages such as mental pain and suffering of apartment owners.”
“The developer has made our lives miserable and took our hard-earned money by making false promises regarding the quantum and quality of what they intended to deliver and then not meeting these commitments,” said Sangeet Chawfla, a resident.
In case each occupant files a complaint over construction quality of individual apartment, the total damages sought can go well beyond R210 crore.
As per rules, the developer had to return the maintenance security deposits to the occupants after the resident body was formed in October 2010, the TWSAOA said.
A spokesperson of Unitech refused to comment saying that it “had not got any communication in this regard”.
Last month, Unitech had also moved court against the owners’ association. A hearing in that case is scheduled for Wednesday.
