The court  asked the railway counsel to obtain a ‘no objection’ certificate from the railway authorities concerned and hand it over to GP Dubey, district forest officer, to execute work, as per its report.

The division bench referring  to its last order issued on October 17, said, “It appears that neither the railway authorities nor the State are serious enough in this matter of public cause. We are informed that no meeting has taken place amongst officials concerned. Railway was  unable to protect its land which was encroached by 300 people besides a temple being established on this site.”

“The Curzon Bridge has been restored and the railway land around it got rescued from encroachers and the temple shifted. There is no justification now to ignore the site and/or abandon it. The UP Government has already sanctioned the requisite funds and the forest department is to develop the site so that it becomes  a beautiful big park on both sides of the bridge. While the UP Government shall have no right on it, railway retains its rights as on date. Work done by the forest department shall be done on behalf of Railways,” the court ordered.

Court asked the chief standing counsel to communicate the orders passed on  October 17 and November 22 to the  chief secretary, UP Government to facilitate co-ordination between the Railway Ministry through divisional railway manager, Northern Railway, Lucknow  and the chief secretary.  Court also directed the Nagar Nigam to maintain streetlights on the Curzon Bridge.
