Barely hours before Maganlal Adivasi was to hang in a jail in Jabalpur, the Supreme Court on Thursday stayed the execution of the 45-year-old man who was awarded capital punishment for butchering his five minor daughters two years ago in Kaneria village in Madhya Pradesh’s Sehore district.
Maganlal was scheduled to be executed on Thursday but his hanging was deferred after an interim stay was granted by the Supreme Court chief justice India P Sathasivam on an application of the Peoples Union for Democratic Rights on Wednesday night.
On Thursday, an division bench of the apex court comprising chief justice P Sathasivam and justice Ranjana Prakash Desai took up the petition for hearing and stayed the execution of Maganlal till further orders.
Senior advocate Vivek Tankha said that petition sought stay on the execution on the grounds that the apex court’s order rejecting the convict’s appeal was not exhaustive which otherwise is necessary in such criminal cases.
Netaji Subhash Chandra Bose Central Jail superintendent Akhilesh Tomar told HT that they have recieved the apex court order staying the execution of Maganlal.
Tomar said that around 12.30 am on August 8 he informed Maganlal that his execution has been stayed and he will not be hanged.
He quoted Maganlal as “thik hai sahib” (ok sir).
The eight family-members of Maganlal including his two wives and son Ajay were relieved when they were informed around 2 am about the stay on the hanging, Tomar added.
Maganlal was convicted for beheading his five minor daughters -- Jamuna (2), Leela (3), Aarti (4), Savita (5) and Phoolkunwar (6) on June 11, 2010, after an argument with his wives.
