The UP conversion law is unconstitutional. But the debate does not end with this one law, as it also replicates many existing provisions from other laws, which have been left standing for too long. India cannot call itself a constitutional democracy until social interference in matters of conscience is eliminated from its laws, once and for all.

The top court said that it was held that if an offence is committed outside the building like in a lawn outside a house, which can be seen by someone from the road or lane outside the boundary wall, then that would certainly be a place within the public view.

The apex court had last year banned automatic arrests and registration of cases under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989, triggering protests in many parts of the country against dilution of the law that was designed to protect marginalised communities from abuse and discrimination.
