Modi government introduced a fresh bill to ban the practice of instant triple talaq in the Lok Sabha on Friday. The Muslim Women (Protection of Rights on Marriage) Bill, 2019, will replace an ordinance issued in February by the previous BJP-led NDA government.The previous bill lapsed with the dissolution of the 16th Lok Sabha last month. The Bill, which proposes to make the practice of instant triple talaq (talaq-e-biddat) a penal offence, had faced objections from the opposition parties which claimed that jail term for a man for divorcing his wife was legally untenable.Under the Muslim Women (Protection of Rights on Marriage) Ordinance, 2019, divorcing through instant triple talaq is illegal, void and will attract a jail term of three years for the husband.The government has included certain safeguards in it such as adding a provision for bail for the accused during trial so that the proposed law could not be misused.Highlights:

The contentious triple talaq bill couldn’t be tabled in Rajya Sabha on Monday as the upper House of Parliament was adjourned after uproar by the Opposition over the bill. The bill that makes the practice of instant divorce among Muslims a criminal offence with a provision of three-year jail term for the erring husband will now be tabled on January 2, 2019, by Union law minister Ravi Shankar Prasad On Sunday, the Congress and the BJP issued whips to their members to be present in the House Monday and other parties have also asked their MPs to be present in full strength when the bill is taken up.The contentious triple talaq bill is likely to face stiff resistance from opposition parties, who are united in their demand for sending it to the select committee for further scrutiny.Law minister Ravi Shankar Prasad will table the bill in the Upper House. It has already been passed by the Lok Sabha, with 245 voting in favour and 11 opposing it, Thursday amid a walkout by the opposition parties. The bill to criminalise triple talaq was passed by Lok Sabha on Thursday. The politically sensitive bill which seeks to make the practice of instant triple talaq among Muslim men a penal offence was moved by Union law and justice minister Ravi Shankar Prasad for discussion in the Parliament’s winter session on Thursday.As the Muslim Women (Protection of Rights on Marriage) Bill, 2018, was taken up for consideration, Leader of the Congress in the House, Mallikarjun Kharge, had suggested it be taken up for discussion next week.The fresh Bill to make the practice of triple talaq among Muslims a penal offence was introduced in Lok Sabha on December 17 to replace an ordinance issued in September. Under the proposed law, giving instant triple talaq will be illegal and void, and will attract a jail term of three years for the husband.The fresh bill will supersede an earlier bill passed in the Lok Sabha and pending in the Rajya Sabha. The earlier bill was approved by the Lower House. But amid opposition by some parties in the upper house, the government had then cleared some amendments, including introduction of a provision of bail, to make it more acceptable.The Lok Sabha had last week on Thursday decided to take up the bill today after the Congress agreed to participate in the debate.
