PRAYAGRAJ The Allahabad high court on Monday adjourned till June 28 (Tuesday) hearing on the petition filed by Parveen Fatima, wife of Javed Mohammad (main accused in June 10 violence in Prayagraj), challenging the demolition of her house on June 12.
The bench comprising Justice Sunita Agarwal and Justice Vikram D Chauhan passed the order on the petition filed by Parveen Fatima and Sumaiya Fatima, wife and daughter of Javed Mohammed.
The court, while adjourning the case, observed: “Let this matter be posted before another Bench, of which one of us (Justice Sunita Agarwal) is not a member. Put up this matter before another Bench tomorrow (June 28, 2022) as fresh after obtaining nomination.”
According to the petitioners , the house doesn’t belong to Javed Mohammad but is owned by his wife Fatima who had received the same as a gift from her parents before her marriage.
They alleged that the Prayagraj Development Authority (PDA) did not serve any notice on Fatima. A notice, with the house number listed, was not addressed to Parveen Fatima, but to her husband Mohammad Javed, the activist and businessman, who was arrested on June 10 on charges of allegedly instigating violent protests over derogatory remarks targeting the Prophet.
In the petition, it was claimed that the house was gifted to Parveen by her parents before marriage and she was paying house tax and water tax from time to time. Even tax receipts were issued in her name. However, no notices were issued in her name before demolition of the house.
