Motor Accident Claims Tribunal awards vegetable seller’s parents, wife Rs8.86 lakh relief

The Motor Accident Claims Tribunal (MACT) has awarded a compensation of ₹8.86 lakh to the kin of a 26-year-old accident victim.
Namdev Gavare, 26, and his friend Amol Tilekar, were proceeding towards Yawat carrying a bundle of Patravadi (eating plates made of dried leaves) on a two-wheeler on February 20, 2010, when they were hit by a Tata Sumo, driven by Mahadev Jaising Falake. Gavare sustained serious injuries on his head and died on the spot. He was a vegetable and fruit seller.
The MACT, presided over by Mohammad Nasir M Saleem, passed the order directing United Insurance Company Ltd; Mahadev Jaising Falake, driver, and Shamappa Guruappa Jamadar, owner of the Sumo, to jointly pay a compensation amount estimated to be worth ₹8.86 lakh with seven per cent interest.
The claim petition was heard ex parte against the driver and the owner, whereas the insurance company contested the petition and denied the nature and cause of the accident.
It stated the age, occupation and source of income of the deceased are denied, but it is admitted that Tata Sumo owned by Jamadar was insured with it. “The company submitted that the accident occurred due to the fault of the rider of the bike and the deceased. They were chitchatting while riding the bike. The rider of the bike rode on the middle of the road negligently and was riding the same in a zigzag manner, and therefore, Falke cannot be held responsible for the accident in question. Hence, the dismissal of the petition is claimed,” it stated.
The deceased parents who are also co-applicants in the compensation plea claimed that their share may kindly be considered while granting the compensation, because they were also dependent on their son.
The tribunal, in its order dated May 5, stated that out of the total of ₹8.86 lakh compensation, an amount of ₹5.36 lakh be apportioned to his wife Deepali, 20, while ₹1.50 lakh each be paid to his parents by account payee cheques.
