Vaiko moves court

Vaiko sought a stay of proceedings against him by the designated POTA Court till disposal of his petition.

MDMK General Secretary Vaiko on Monday filed a petition in Madras High Court for a direction to the Tamilnadu government to withdraw the POTA case against him in view of the central POTA Review Committee finding that the case did not constitute an offence under the anti-terror law.

He also sought a stay of proceedings against him by the designated POTA Court till disposal of his petition.

In his petition, Vaiko said that if the trial continued, not only would his petition become in fructuous but would also deprive him of the relief granted by the committee, which was a statutory body.

Justice A B Saharya Committee on April 8, which concluded that the case against Vaiko did not constitute an offence under POTA, had directed the state Government to immediately take suitable steps, including giving instructions to the Public Prosecutor, to obtain appropriate orders from concerned courts in the case, in accordance with the law.
