Rapper Lil Durk, whose legal name is Durk Banks, will not face trial on federal racketeering charges until August 30, 2027. According to LA Magazine, a California federal judge granted a defense request to postpone proceedings. The court ruled that the case’s unusual complexity, the large volume of evidence and the addition of new charges required significantly more preparation time for all parties.

Originally, the trial was scheduled on October 5. However, speculation around the trial date postponement emerged after the court set a separate November 4 bond hearing.
Wednesday’s order confirmed that the racketeering case will instead begin on August 30, 2027, at 8:30 am.

Why did the court delay the trial?
Defense attorneys for Banks requested a continuance after prosecutors filed a fourth superseding indictment that introduced new charges shortly before the earlier trial date. Lawyers representing co-defendants DeAndre Wilson and David Lindsey joined the request.
In the defense motion, attorneys argued that, “Failure to grant the continuance would unreasonably deny defendant continuity of counsel and would deny defense counsel the reasonable time necessary for effective preparation, taking into account the exercise of due diligence.”

Fitzgerald also agreed that the prosecution involves “unusual complexity.” The judge cited the number of defendants, the nature of the allegations and the extensive evidence that both sides must review to support the postponement decision.
The court said the parties must examine a substantial amount evidence which includes digital evidence and investigative reports coupled with witness materials.

What are the new charges against Lil Durk?
The delayed proceedings involve charges added on July 31, only weeks before Banks’ earlier federal trial was scheduled to begin.
Prosecutors have now alleged that Banks led a criminal organization known as the “Banks Gang Enterprise.” The new indictment includes a murder in aid of racketeering (VICAR) charge.
According to the LA Mag, under federal law, prosecutors must prove that a murder occurred under California law. The prosecutors must also prove that the murder was committed to maintain or increase a defendant’s position within an alleged criminal enterprise.
Judge Fitzgerald previously ruled that these new allegations were filed too close to the August 2026 trial date. He therefore severed them from the earlier proceedings.
Earlier this year, he was acquitted in the federal trial for an alleged murder-for-hire conspiracy connected to the death of Savaiy’a Robinson. Banks was acquitted in that case.
