The Supreme Court has asked the Centre and all state governments to respond to a set of proposed guidelines on the operation of X-ray units in various laboratories across the country.
The guidelines suggest that a patient should be apprised of the ill-effects of being exposing to radioactive rays before the X-Ray test.
A bench headed by Chief Justice of India KG Balakrishnan gave the Centre and states four weeks to respond. So far, only Karnataka, Tamil Nadu and Kerala have expressed willingness to accept the draft guidelines. The Centre and the other states are yet to respond. The court asked the Centre to study the guidelines and make further suggestions.
In a public interest litigation filed in the court in 2001, J.P. Sharma alleged safety measures for operating thousands of X-Ray units prescribed under the Atomic Energy Act 1962, Radiation Rules 1971 and Atomic Energy Regulatory Board guidelines were not being followed properly.
On April 28, 2008, the court appointed advocate Anis Suhrawardy as amicus curiae (court’s friend) to frame draft guidelines on safety measures to be followed by X-Ray units. He suggested that only qualified radiologist should operate such machines. His report said exposure to radioactive rays could lead to inhibition of cell division, chromosome aberrations, gene mutation, cell death, somatic effects and hereditary effects.
