Hearing a plea of a 14-year-old rape victim, who is a five-months pregnant and seeking permission for Medical Termination of Pregnancy (MTP), a local court has issued notice to the state government for September 22.
In her plea, the victim prayed that she cannot live with this blemish and moreover her mind and body are too immature to bear the burden of the child. She is undergoing treatment in a hospital. The victim belongs to a backward community.
The accused in the case, Nihal Singh (57), was a neighbour who used to visit her house. He allegedly raped the girl, a student of Class 8, for almost four months.
One day when she complained of pain in stomach, her parents who are labourers took her to a doctor where it was found that she was five months pregnant. The accused was arrested under the Protection of Children from Sexual Offences (POCSO) Act and sent to jail on the charge of rape.
Lal Bahabur Khowal, counsel for the victim, on Sunday said, "The court can allow abortion in case of rape under Section 3(2)(I) MTP Act, 1971, and the girl is still a minor. The Gujarat (2010) and Delhi high courts (2013) had already allowed MTP (abortion) in such cases. The girl and her parents are passing through immense agony and pain."
