Delivery of used phone: Amazon told to pay Rs 10,000 compensation

For handing over a used mobile phone to a customer and later neither replacing it with a new one nor refunding the amount, the SAS Nagar consumer disputes redressal forum has directed the online shopping portal Amazon India to pay `10,000 as compensation for deficient services.

For handing over a used mobile phone to a customer and later neither replacing it with a new one nor refunding the amount, the SAS Nagar consumer disputes redressal forum has directed the online shopping portal Amazon India to pay `10,000 as compensation for deficient services.

Disposing of a complaint filed by Phase-7 resident Sunpreet Kaur, the consumer forum also directed the firm to refund the amount paid for the handset with 9% interest from December, 2014, till actual payment.

Sunpreet had ordered the phone on the portal www.amazon.in on November 21, 2014. On December 2, she received the phone by making a payment of `4,652 at the time of delivery.

On opening the sealed box, she found the handset was a used one, with scratches on its body. On demanding a replacement of refund, the firm merely tendered an apology, stating the refund could not be made till the mobile phone was returned.

Sunpreet complained the online portal neither collected the handset from her residence nor refunded the amountto her.
Despite a notice, no one appeared on behalf of Amazon India; thus, the complaint was proceeded exparte.
