Punjab and Haryana high court on Wednesday dismissed a petition challenging Punjab government's 2011 notification upgrading Moga municipal council to a corporation.
A bench headed by justice Rajiv Narain Raina, after finding that the state government had followed proper procedure in the matter, dismissed the petition filed by Parshotam Puri and others.
The high court had on April 20 stayed July 26, 2011, notification declaring the municipal council of Moga to be a larger urban area and constituting a municipal corporation there.
The petitioners had submitted that the Moga municipal body cannot be converted into a corporation as it did not fulfill the desired criteria of population of more than three lakh, number of voters and required budget.
Earlier, the high court had granted a stay in the case on October 17 last year, which was later vacated on March 21 due to withdrawal of the plea by the petitioners, including sitting councillor from Ward number 4 Surender Singh. After this, Parshotam Puri and others had moved the high court challenging the state government's notification.
In similar cases, the high court had on May 8 restored municipal corporation status of Pathankot, Phagwara and Mohali municipal bodies after upholding state government's notifications.
