The actor had filed an anticipatory bail application which has been dismissed. The actor also filed a quashing petition before the High Court, but that too was dismmised by the High Court. The matter started in 2006, when accoridng to the complainants, Upadhyaya floated a company called Mihir Virani Multi trade Private limited. They printed catalogues that said the company belonged to Star Plus. Upadhyay also presided over meetings and the complainant was appointed the C&F agent of the marketing of membership pins. He gave them seven and a half lakh after which, they claim, Upadhyay vanished.

Upadhyay had earlier threatened to sue Shrawan Kumar pointing out that he was being made a soft target since he is a celebrity.
