The victim Jhum Mohanty, a resident of Damanjodi in Koraput district, was travelling in Hirakhand Express from Damanjodi to Bhubaneswar in November. A co-passenger allegedly tried to befriend her and later tried to sexually harass her after which she raised an alarm. When the train reached Bhubaneswar, the government railway police (GRP) came to Mohanty's compartment and took the accused, Santanu Kumar Rajguru, with them.

An FIR was lodged, but the police dragged their feet to act on the complaint after the accused revealed that he was a serving judge and currently posted as the chief judicial magistrate of Nowrangpur district.
