Cuttack city deputy commissioner of police (DCP) Amitendra Nath Sinha filed the suit against city CPI(M) leader Subash Singh in the SDJM's court here.

The CPM leader, as the convener of Cuttack Bachao Committee, had issued a press release on Thursday alleging the DCP was present at the Bagalpur police firing spot on Monday and it was at his (Sinha's) behest, the police opened fire killing advocate Bishnu Charan Dash on the spot.

Sinha asserted that he was not present at the spot and the area did not fall under his jurisdiction. He claimed it was under the jurisdiction of Cuttack Rural SP Rajat Kanti Mishra who was injured the same day in stone pelting by the mob.
