The Rajasthan High Court on Monday issued notices to the Centre and state government to explain the utility of continuing with the reservation accorded to SCs, STs and others in legislatures and jobs.
The direction came on a petition which challenged the 109th Constitutional amendment extending reservation policy by another ten years, to be operational from January 25, 2010.
As per the amended Article 334, the existing quota in public jobs and educational institutions has been extended for the backward classes including SC, STs for next 10 years.
A division bench of justices R C Gandhi and G S Saraf issued notices to the Central and the state government to explain the utility of continuing with the reservation in parliamentary and legislative seats for the SC, ST, and Anglo-Indian community.
Social activist Amarnath Vaish and another petitioner contended that 60 years was more than sufficient to have proper representation of such communities in the Lok Sabha and state legislatures.
Vaish has also challenged quota for the backward class and women in public employment and for the SC, ST and Anglo-Indians in Parliament and state legislatures.
