The noose on Monday tightened for a senior BSF official allegedly involved in the sex racket in Jammu and Kashmir after the Supreme Court declined to entertain his plea for anticipatory bail and asked him to make the same in the Jammu and Kashmir High Court.
A vacation Bench comprising Justice Arijit Pasayat and Justice CK Thakker declined to entertain the petition by the officer of DIG rank, now posted with BSF in north-east, seeking anticipatory bail.
While refusing to entertain his bail plea, the Apex Court asked him to approach the Jammu and Kashmir High Court for the same.
The BSF official had been summoned by the CBI to appear before it in Srinagar, where he had served earlier, to undergo a Test Indentification Parade (TIP) before a minor girl allegedly raped by him and ten other persons.
In a related development, the vacation bench also rejected the plea of Deputy Superintendent of state police Mohammed Ashraf Mir challenging the High Court order that no bail application or any other plea relating to the case will be entertained by any subordinate court without bringing the fact to its notice.
"Though, normally High Court cannot pass order that the accused cannot move subordinate court for bail, due to the peculiar circumstance of this case we do not want to interfere with the order of the High Court," the apex court Bench said dismissing Mir's petition.
