Mohammed Ajmal Amir Kasab is not a minor. He is over 20 years of age, says the ossification test result conducted on Kasab.
The report submitted to the court did not have any visible effect on the lone surviving Pakistani gunman from the 26/11 terror attacks. He just rubbed his nose and acknowledged the presence of his defence lawyer with a smile. Kasab had told the expert committee which submitted the report that his age was 17 years and six months at the time of attack.
Ujjwal Nikam, special public prosecutor, told the court that he would like to examine the witnesses. Nikam reasoned that the test was not ‘conclusive proof’, and was just an expert opinion.
On April 24, Judge Tahaiyani had approved an application filed by Nikam to find out if Kasab was a minor. The court had also allowed the prosecutor to examine two witnesses comprising of a doctor and jailor to prove that Kasab’s age.
Swathi Sathe, the superintendent of Arthur Road prison, told the court that before Kasab was admitted his particulars had to be filled up in the jail records.
During the procedure, Kasab had told Sathe that he was born on 13 September 1987 and was 21 years old. The prosecution also examined Dr Venkatraman Murthy, a resident doctor at Nair Hospital, who was the first person to treat an injured Kasab on November 26, 2008. Kasab had told him that he was 21.
Defence advocate Kazmi has now sought to examine the casuality medical officer and the record assistant who were present at Nair Hospital.
