A 32-year-old mentally challenged Muslim woman has moved a family court in Chennai seeking Rs five lakh as one-time maintenance from her father, who had "deserted" her and her mother to live with another woman.
In a suit filed in the Principal Family Court Ghousia, represented by her mother Kamarunissa Baby, also sought a direction restraining Southern Railways, from which her father Khadar Sherrif has sought voluntary retirement recently, from disbursing the retirement benefits due to him.
When the petition came up for hearing, family court Judge P Ramalingam directed the railways not to disburse retirement benefits to Sherrif, a server-cum-cook with the railways catering, till July 10 when the suit would be heard.
Stating that she was unable to file the petition without the support of her mother, Ghousia contended that at present her father was paying Rs 500 per month as maintenance and if he retired from service even this amount may not be forthcoming as he would move out of the Railway quarters to stay elsewhere with his "concubine".
Submitting that her parents were married on October 11, 1970 according to Muslim rites and customs and that she was born on July 6, 1976, the woman said her father developed an intimacy with one Malliga and thereafter began ill-treating her and her mother.
