Observing that the ongoing strike has created a "disturbing situation" in the state, the Jammu and Kashmir High Court today directed the government to take legal action against the agitating employees and said 'it was not a fundamental right to go on stir.'
"We feel the state must take all necessary steps to take legal action against the employees who have proceeded on strike," a division bench of justices Hakim Imtiyaz Hussan and Muzaffar Attar said on a PIL.
The court said a "disturbing situation" has arisen due to the strike of the employees.
"The strike has adversely affected functioning of the government. It has created numerous problems for common man so far as medicare, education, supply of rations and other essential supplies are concerned," the bench said.
"There is no fundamental, legal or statutory right for an employee to go on strike", the court observed.
About 4.50 lakh employees have been on stir since April 3 demanding release of arrears as per the 6th Pay Commission report and raise in the retirement age from 58 to 60.
The strike has paralysed functioning of various departments affecting lives of common man.
